- Basics of the European community law
- Relationship between community law and national law

Note: For both Staatsrecht I and II, tutorials (Ergänzungsvorlesungen) are offered. These are taught by assisstants and deal with case studies. Students are highly recommended to attend these tutorials in addition to the lectures (2hrs, 4 credits).

 


Public law II: constitutional rights
Staatsrecht II: Grundrechte

This course deals with the constitutional rights of the Grundgesetz and their setting in the common European protection system of the European Convention of Human Rights. The doctrines of general constitutional rights and namely different protection functions are dealt with, as well as single constitutional rights and their coverage through the constitutional complaint procedure at the Bundesverfassungsgericht.

 

These texts are necessary to help follow the course: the Grundgesetz, the Bundesverfassungsgerichtsgesetz and the European Convention on Human Rights (Europäische Menschenrechtskonvention), e.g. P. Kirchhof/C. Kreuter-Kirchhof, 46. Aufl. 2008.

Practical Course about Public Law for Beginners
Übungen im öffentlichen Recht für Anfänger

The lecture trains the work on constitutional law cases with case discussions, class exercises and term papers. Previous knowledge of civil rights as well as at least contemporaneous attendance of the lecture law of public organization.

The achievement of the course certificate assumes a term paper and a class exercises with at least 4 points (sufficient). For the intermediate examination exercise, the second class exercise needs to be passed.

This course deals with the fundamental terms of Administrative Law and Law of Administrative Procedure. This course takes place two hours a week during the 2007 summer term.
Knowledge of the subjects dealt with in this lecture is an essential requirement to pass the Advanced Certificate in Public Law.

Contents of the lesson:
From the field of general administrative law, this course aims to further understanding of the doctrine of the administrative act, law of administrative service of notes and administrative enforcement, law of public compensation performance.
From the law on administrative procedure: Protest procedure, temporary legal protection and exploring further the subjects covered during the winter semester.

Police and security law

This lecture deals with the compulsory fields of the first juridical state exam according to § 5 Abs. 2 Nr. 5c JAPO, literally the general security and police law (Landesstraf- und Verordnungsgesetz, Polizeiaufgabengesetz und Polizeiorganisationsgesetz). Students are introduced to the solution of facts in the police and security law. It is possible to sit a written exam at the end of the semester. Knowledge of general administrative law and the law on the administrative procedure will be necessary to pass the exam. It is strongly recommended that participants of this lecture also attend the lecture on General administrative law.

The main features of the law on building regulations and the law on planning for building projects are part of the compulsory subjects for the 1st Juridical state exam (Staatsexamen). Since the (public) building law is a part of the optional subject W 6, this lecture is also a part of the course of this optional subject.


At the end of the course, it will be possible to sit a written exam. Lecture notes giving details on the structure of the lecture, recommended reading, and reviewing the most important knowledge in building law, will be available at the beginning of the semester.

Municipal law
Kommunalrecht

This lecture is a compulsory subject of special administrative law. In the first instance, the lectures expand on the constitutionally guaranteed rights of the municipal self government, especially the tasks of the own and delegated sphere of functions as well as the instruments of public control. Particular attention is paid to the municipal right to issue charters and ordinances. A further main focus is the subject of public establishments of the municipalities and communal organization. In exploring these issues, the structure and function of the single organs, municipal election law and litigations about the constitution of the local authorities are also covered.
To conclude, the law on economic activities and the fiscal charge law, as well as the different forms of municipal collaboration, are presented.
The numerous influences of EU-law, especially on the subject of provision for elementary requirements, are dealt with in detail.
